THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES (SEE SECTIONS 6, 9, AND 10). THESE TERMS FORM AN ESSENTIAL BASIS OF OUR AGREEMENT. PLEASE PRINT AND RETAIN A COPY OF THIS AGREEMENT FOR YOUR RECORDS.
The use of the Malorie Tadimi Marketing Smarter app (“App”), owned and maintained by Tadimi Group LLC (“Tadimi Group LLC,” “we,” “our,” “us”), is governed by the policies, terms, and conditions set forth below. Please read them carefully. We offer the App, including all information, tools, and services available within it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By accessing, using, or subscribing to the App, you and your business agree to the terms set forth herein. If you do not agree to these terms in their entirety, you are not authorized to use the App.
THIS IS A BINDING AGREEMENT.
These Terms of Use (“Terms”) together with our Privacy Policy form a legally binding agreement (“Agreement”) between you and your business (“you” or “customer”) and Tadimi Group LLC. This Agreement governs your access to, use of, and attempted use of the Malorie Tadimi Marketing Smarter app and the services provided by Tadimi Group LLC.
SECTION 1 – APP USE
The Malorie Tadimi Marketing Smarter app is intended for businesses operated by adults. By downloading or using the App, you affirm that you are at least 18 years old or the legal age of majority in your jurisdiction, operate a business, have the legal capacity to enter into a binding contract with us, and have read this Agreement, understanding and agreeing to its terms.
SECTION 2 – USER CONDUCT AND RESTRICTIONS
All elements of the Malorie Tadimi Marketing Smarter app, including but not limited to text, graphics, tools, and content, are protected by copyright and other intellectual property laws. No part of the App may be copied, reproduced, distributed, or transmitted in any form without express written consent. Use of any Tadimi Group LLC intellectual property without authorization is prohibited.
You agree not to:
Use the App in an unlawful or harmful manner. Commit unauthorized access or modification of the App or associated systems.Publish offensive or defamatory material via the App.
SECTION 3 – PRIVACY POLICY
Your use of the Malorie Tadimi Marketing Smarter app is subject to our Privacy Policy, which governs how we handle your data. Our Privacy Policy can be viewed at

SECTION 4 – SUBSCRIPTIONS AND PAYMENTS
Access to the Malorie Tadimi Marketing Smarter app does not require subscription fees or payments.

SECTION 5 – DISCLAIMER OF RESULTS
While the Malorie Tadimi Marketing Smarter app provides tools and resources to enhance your marketing efforts, your individual results may vary based on factors outside of our control. Tadimi Group LLC does not guarantee specific business outcomes, revenue increases, or other financial metrics.
SECTION 6 – LIMITATIONS OF LIABILITY
Except where prohibited by law, Tadimi Group LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.

Indemnification:
You agree to indemnify and hold harmless Tadimi Group LLC from any claims resulting from your use of the App.
Termination:
We reserve the right to suspend or terminate access to the Malorie Tadimi Marketing Smarter app at our sole discretion if these Terms are violated.
Governing Law:
This Agreement is governed by the laws of the State of Louisiana, and any disputes will be resolved under binding arbitration as outlined in Section 11.
